ANTHBOT lawn mowers (including Pion, Genie, and other series) are plug and play smart robotic lawn mowers that can be controlled via mobile APP (including “Intelligent Mower” and “ANTHBOT” ). ANTHBOT lawn mowers and the accompanying Apps are provided by ANTHBOT (SG) PTE. LTD. (hereinafter referred to as "we", "us", "ANTHBOT (SG)" or the "Company"). Thank you very much for your trust in us. We are committed to protecting your privacy.

Through this Privacy Policy, we would like to explain to you how we collect, use, store, share and transfer your personal information when you use our lawn mower, and the ways in which we provide you to access, update, delete and protect your information. Please be sure to read and understand this Privacy Policy carefully before using our lawn mower, and use our products or services after confirming that you fully understood and agreed to the Policy. If you have any questions, comments or suggestions about the content of this Policy and our processing of personal information, you can contact us through the contact information provided in this Privacy Policy.

 

1. How We Collect and Use Your Personal Information

We will only process your personal information for the purpose of providing features when you use our services. You will only be required to provide personal information that is essential, while you can provide other personal information on a voluntary basis. We will indicate whether input fields are mandatory or optional and explain the impact or consequences when you do not provide the information. We will collect your information through means such as your active provision, system collection, and third parties’ provision. We will inform you concerning the specific details in the relevant section of this Policy.

 

The lawn mower is equipped with a control panel, you can perform the basic setup on it. If you don’t bind the mower to your account through the App, we will not collect your personal information, but you can only use limited functionality of the mower, and cannot control the mower through the App. When you use the App, we may collect and use your personal information for the following purposes as described in this Privacy Policy:

 

1.1                   Registration and Login

You need to register to use our App, during the registration process, you are required to provide the requested information, including your country, proffered language, email address, and password. As part of the registration process, we will request your consent to use the aforementioned data. We use your personal information to assist you in completing user registration and to provide you with products or services.

 

The legal basis for processing the registration data is your consent, as well as the necessity to fulfill or initiate a contractual relationship between you and us and to perform obligations under the contract. If you do not provide the aforementioned information, we will be unable to create an account for you.

 

1.2                   Smart Device Binding

After setting up your account, you need you bind the lawn mower to your account to control it through the mobile phone. In the process of the binding, you need to provide the WiFi name and its password, turn on your Bluetooth for the connection. Please be noted that in Android 6.0 to 11.0 versions, the Bluetooth operations are associated with location services. This means if your mobile phone runs on these versions, you need to grant the location permission to enable Bluetooth. We will not collect your precise location information in this process. If your mobile phone runs on iOS system or Android 12.0 and later versions, we will not request access to your location permission, as these systems no longer require location access for Bluetooth functionality.

 

The legal basis for processing the aforementioned data is your consent, as well as the necessity to fulfill or initiate a contractual relationship between you and us and to perform obligations under the contract. If you do not provide the aforementioned information, we will be unable to help you bind the device.

 

1.3                   Smart Device Sharing

After binding the lawn mower to your account, you can share the device with other people for them to control and monitor the device on their App. In this process, you need to provide the shared account to us. Before providing it to us, please be sure that you have been authorized by the account owner to provide the information to us.

 

The legal basis for processing the shared account is user consent, as well as the necessity to fulfill the contractual relationship between the user and us and to perform obligations under the contract. If you do not provide the aforementioned information, we will be unable to help you share the device.

 

1.4                   Smart Device Control and Monitoring

In order to facilitate you to control the lawn mower, we will connect your smart hardware via WiFi and obtain the relevant content information generated by the lawn mower. You can set device scene and create maps for the mowing on your App, in this process, you need to provide the map, scene name, conditions, executed actions, and effective period. After the setting-up, you can control the lawn mower to perform mowing, intelligent recharging, resetting PIN code, fault alarm, and other operations through the App. In this process, we collect data generated by the device, including the mowing schedule, mowing records, the device’s status, the battery and blades life.

 

For the lawn mower to work properly, the camera on the device is used to adopt obstacle detection and avoidance technology and improve the performance of the mower. In the mowing process, it will capture environment and spatial information, combined with your specification, to create its location map, prohibited areas and clean areas, to identify types of obstacles encountered and the obstacle’s location. The captured image is automatically desensitized so that it does not contain any human, building/house, or location information, and is stored locally on the device.

 

The legal basis for processing the aforementioned data is your consent, as well as the necessity to fulfill or initiate a contractual relationship between you and us and to perform obligations under the contract. If you do not provide the aforementioned information, we will not be able to provide the control and monitor feature.

 

1.5                   Log Uploading

If a malfunction occurs during the operation of the lawn mower, you can upload the device and App running logs by enabling the “Collect App Logs” switch in the App. We may use the uploaded data to diagnose and resolve the malfunction.

 

The legal basis for processing the uploaded data is your consent, as well as the necessity to fulfill or initiate a contractual relationship between you and us and to perform obligations under the contract. If you do not provide the uploaded data, we will not be able to identify, diagnose or resolve the malfunction.

 

1.6                   Find My Device

When you activate the anti-theft mode, we may collect the device’s GPS location if it leaves the maps. If the device is within the boundary of maps you created, we will not collect the device’s location. However, if it is out of the boundary of maps, to prevent theft, loss, and other incidents, we collect device’s latest location to show it on the App for you to find the device.

 

the legal basis for processing the device’s location data is your consent, as well as the necessity to protect your property security. If you do not activate the anti-theft mode, we will not be able to show the location of device for you to find it.

 

1.7                   Official Store

To provide you with a more convenient shopping experience, we have integrated our official website (anthbot.com) into the App. You can access the official website through the entry provided in the App to browse and purchase products. Your personal information collected and processed when you visit the website will not be transferred to us and is governed by the website’s Privacy Policy, please read it and use the official store after you have agreed to it.

 

1.8                   Customer Services

You may contact us using the online support service provided in the App or through email address provided in this Policy. When you contact us, you may provide personal information, including your identity, contact information, problems you encountered, and your communication with us. We use the information to respond to your questions and service requests.

 

To provide you with more timely and convenient customer service, we have integrated a third-party AI customer service tool into the online support service. When you use the AI customer service, we transfer your product model and your inputs to the AI customer service system. Please be assured that we will not use your inputs or your communications with us to train the model that powers the AI customer service.

 

The legal basis for processing customer service data is your consent, as well as the necessity to provide you with customer service. If you do not agree to this processing, we will be unable to offer you the customer services.

 

1.9                   Product and Service Improvement

We may collect the International Mobile Equipment Identity Code (IMEI), network device address (MAC), mobile phone model, mobile phone system version number, system number, system ID number, screen resolution, Internet type, CPU serial number, current APP name, version number, package, software usage time and frequency, software crash logs, etc., for the purpose of counting the number of users of our products, analyzing the usage status of products, troubleshooting the causes of crashes, and reducing crashes, so as to continuously improve our products. This information does not involve your personal identity or other private information.

 

The legal basis for processing the aforementioned data is your consent, as well as the pursue of our legitimate interest. We confirm that this legitimate interest is beneficial to users and will not have a negative impact on their personal rights and interests.

 

1.10              Security assurance

In order to improve the security of your use of the services provided by us and our affiliates and partners, protect the personal and property safety of you or other users or the public from infringement, better prevent security risks such as phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, and network intrusions, and more accurately identify violations of laws and regulations or relevant rules of the agreement. We may use or integrate your account information, device information, software usage information, and information shared by our affiliates and partners with your authorization or in accordance with the law for identity verification, detection and prevention of security incidents, and take necessary recording, auditing, analysis, and disposal measures in accordance with the law.

 

The legal basis for processing the aforementioned data is the necessity for security assurance, as well as the pursue of our legitimate interest. Ensuring the secure and stable operation of our products and protecting them from attacks by malicious actors, such as those involved in the dark and gray industries, represents our legitimate and justifiable interests. We confirm that this legitimate interest is beneficial to users and will not have a negative impact on their personal rights and interests.

 

1.11              Marketing

Under the premise of complying with laws and regulations, we may anonymize, aggregate, desensitize and encrypt your personal information to form statistical information(the statistical information cannot identify any individual users) to display and push relevant services, products or functions to you. The pseudonymized or anonymized data is not considered personal information, and we will not use the pseudonymized or anonymized data for other purposes not specified in this Policy.

 

2. How We Store Your Personal Information

Personal information collected and generated by us via the ANTHBOT/Mower App are stored on AWS server located in German.

 

Data generated by the devices are store on AWS server. For Pion series, device data are stored in the U.S. For Genie series, device data are stored in your country/region. For example, device data generated in Europe are stored in German, those generated in the U.K. are stored in the U.K, and those generated in the U.S. are stored in the U.S. This information may be sent to, accessed, stored, and displayed in your country, region, or location where we collect information and materials.

 

We will only store your personal information for the period necessary for the purposes of this Policy and the time limit required by laws and regulations. We will delete your personal information as soon as the reason for storing it no longer applies. The data may remain stored beyond this period if this is provided for due to legal requirements to which we are subject, for example in respect of legal retention or documentation obligations. In such an event, we delete your personal information once the requirements cease to apply.

 

If we stop operating our products or services, we will promptly cease collecting your personal information, notify you of the cessation of operation through individual notices or public announcements, and delete or anonymize the personal information we have stored.

 

We attach great importance to information security and have established a dedicated technical team to establish systems and procedures that comply with data security technology standards. In addition, we also strive to protect your personal information from being accessed, used, or disclosed by unauthorized access through multiple measures such as access control and security incident handling. But please understand that the rapid development of Internet technology and possible malicious attacks may make the 100% information security impossible, and certain security issues beyond our control may occur. In the event of such scenarios, we will do our utmost to dispose of security incidents in a timely manner. As one of the preventive measures in advance, we also remind you to strengthen the security of your accounts and information by using more complicated passwords and change it regularly, carefully disclose your personal information, and pay attention to the settings of device permissions when replacing devices. We will also remind you of new security attacks and precautions in the form of occasional notifications, therefore you shall pay close attention to these notifications.

 

3. How We Transfer Your Personal Information

We may transfer your personal information to the following categories of recipients. Further, we do not share personal information with third parties for their own marketing purposes.

 

3.1                   Our Affiliates

We may transfer your personal information to our affiliates because they could provide assistance in operation, development and improvement of our services. Our affiliates take organizational and technical measures to safeguard your personal information and never use your personal information in contraction to this Policy.

 

3.2                   Our Business Partners

We employ business partners to perform functions on our behalf. Examples include the Cloud service provider, and the customer services provider. These business partners may have access to personal information needed to perform their functions but may not use it for other purposes. Further, they must process the personal information in accordance with this Policy and as permitted by applicable data protection laws.

 

3.3                   Public Authorities

We may transfer personal information if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, we also may disclose personal information (i) in response to a law enforcement or public agency’s request; (ii) if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of end users; (iii) to protect the security or integrity of our sites, applications, and other technology, as well as the technology of our service providers; or (iv) enable us to take precautions against liability.

 

We will not transfer the data to third parties without your explicit consent, in particular not for advertising and marketing purposes. Your personal information shall only be transferred if you have given your consent to do so, or if we are entitled or obliged to do so due to legal regulations and/or official or judicial orders. This may especially involve the provision of information for law enforcement purposes, for averting danger, or for enforcing intellectual property rights.

 

During transmission, we have implemented technical measures such as https encryption transmission protocol, etc. to ensure the data security during the transmission process.

 

We only use your personal information to provide the services you request. If we cooperated with external service providers in the provision of services, they shall also only access the data for the purpose of providing services. We use technical and organizational measures to ensure compliance with the data protection regulations and also ask for compliance on the part of our external service providers in this respect.

 

We do not sell your personal information including as “sale” is defined in California. We also do not “share” your personal information as that term is defined in California.

 

4. The Cross-Border Transfer of Personal Information

You acknowledge and agree that we may access and process personal information on a global basis as necessary to provide the products and services, and in particular that personal information may be transferred to and processed by us in Chinese Mainland and other jurisdictions where our affiliates and business partners have operations.

 

Wherever personal information is transferred outside its country of origin, each party will ensure such transfers are made in compliance with the requirements of applicable data protection laws and regulations.

 

In the event of device malfunction or failure, necessary data, including the user’s email address, the mower’s SN, the product’s ID, and event logs, are transferred  from EU, UK to Chinese Mainland for limited number of operations and maintenance personnel to resolve the malfunction and improve device’s performance. The EU Standard Contract Clauses (SCCs) and the UK Addendum to the EU SCCs are signed by the data exporter and data importer. We also conduct strict access control and relevant technical measures to protect the security of data.

 

5. How We Protect Your Personal Information

We have implemented industry-standard security measures to protect the personal information you provide from unauthorized access, public disclosure, use, modification, damage or loss. We will take all reasonable and practicable measures to protect your personal information.

 

We deploy an access control mechanism on the server, adopt the principle of minimum sufficient authorization for staff who may have access to your personal information, and regularly check the list of access personnel and access records. The server systems on which we store users' personal information are security hardened operating systems. We conduct account audits and monitoring of server operations. If it is found that the server operating system with security problems in the external announcement, we will carry out server security upgrades as soon as possible to ensure the security of all server systems and applications.

 

We regularly hold training on laws and regulations related to the protection of personal information for our staff to strengthen their awareness of personal privacy protection.

 

In the unfortunate event that our physical, technical or management protection measures are damaged, we will promptly activate the emergency plan to prevent the expansion of the security incident, report to the competent national authorities in accordance with the requirements of laws and regulations, and promptly inform you of the basic situation, possible impact, measures taken or to be taken in a reasonable and effective manner such as push and announcement.

 

6. Your Right to Manage Your Personal Information

Subject to possible restrictions under applicable laws, as a data subject, you have the following rights

 

6.1                   Right of access

you have the right to obtain from the us confirmation as to whether or not your personal information is being processed; you can also request a copy of your personal information that are undergoing processing.

 

6.2                   Right to rectification

you have the right to obtain from us without undue delay the rectification of inaccurate or incomplete personal information.

 

6.3                   Right to erasure (right to be forgotten)

you have the right to obtain from us the erasure of personal information if the following circumstances occur:

1          The personal information is no longer necessary for the purposes for which it was collected or otherwise processed;

2          You withdraw the consent on which the processing is based, and there is no other legal ground for the processing;

3          You object to the processing, and there are no overriding legitimate grounds for continuing the processing;

4          The personal information has been unlawfully processed;

5          The personal information must be erased to comply with a legal obligation under Union or Member State law to which the controller is subject;

6          The personal information was collected from minors (the specific age shall be subject to the legal provisions of the region where it applies; for instance, the EU defines a child as a person under the age of 16).

 

6.4                   Right to restriction of processing

you have the right to obtain from us the restriction of processing where one of the following applies:

1          The accuracy of the personal information is contested, for the period needed to verify the accuracy of the personal information;

2          The processing is unlawful, and you oppose the erasure of the personal information and request the restriction of its use instead;

3          We no longer need the personal information for the purposes of the processing, but you require it for the establishment, exercise or defense of a legal claim;

4          You have objected to the processing, pending verification of whether our legitimate grounds override yours.

 

6.5                   Right to data portability

you have the right to receive your personal information in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller provided that:

1 the processing is based on consent; and

2 the processing is carried out by automated means.

 

6.6                   Right to object

you have the right to object to data processing based on specific reasons, including:

1 processing based on legitimate interests;

2 processing based on public interest or official authority;

3 when personal information is used for direct marketing, you can object at any time;

4 for scientific, historical research, or statistical purposes, unless it involves public interest.

 

6.7                   Right not to be subject to automated decision-making (including profiling)

you have the right not to be subject to decisions based solely on automated processing, especially when the decision has legal consequences or significantly affects the data subject.

 

6.8                   Right to complaint

If you are of the opinion that our processing of your personal information by us is not in compliance with this Policy or the applicable data protection regulations, you have the right to make a complaint to a regulatory authority.

 

We will respond to your requests within 30 days or as required by the applicable law and regulation in your jurisdiction (if the request is complex or you have made a number of requests).

 

Please notice, the types of rights regarding personal information vary across jurisdictions due to differences in applicable laws and regulations. For more detailed information about the specific rights and applicable response times, please refer to the Appendix.

 

7. Protection of Minors' Personal Information

Our products and services are not directed to minors. We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected personal information from a minor, we will take steps to delete such information as soon as possible. Parents or guardians who believe that their child has provided us with personal information may contact us, and we will promptly delete the information upon verification.

 

8. Scope of Application of Privacy Policy

This Privacy Policy applies to ANTHBOT lawn mowers (including Pion, Genie, and other series) and the accompanying Apps (including “Intelligent Mower” and “ANTHBOT”).  Other products and services of us will be subject to the privacy policy of the relevant product or service. In particular, this Privacy Policy does not apply in the following cases:

1          Embedding our product (or services) into third-party products (or services), information collected by third-party products (or services).

2          Information collected by third party services, advertisements, or other companies, organizations, or individuals that are accessed in our products (or services).

 

9. Changes and Revisions to The Privacy Policy

We may update this Policy from time to time in response to changing legal, technical or business developments.

 

When we update our Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make and as required by applicable laws, such as by pushing the amended Policy to your message.

 

The up-to-date version of the Privacy Policy can be accessed directly via our App at all times. We recommend that you familiarize yourself regularly with any changes to this Policy.

We have appointed a data protection officer to support us in relation to data privacy issues and with whom you can also make contact directly. Our data protection officer is available to you to deal with queries relating to our processing of personal data or to provide other information on data privacy issues. We do not sell or share the personal information of California consumers as those terms are defined under California law.

 

  1. California Privacy Rights

California residents have a right to knowledge, access, correction, and deletion of their personal information under the CCPA. California consumers also have a right to opt out of the sale or sharing of their personal information by a business, and a right not to be discriminated against for exercising their California privacy rights.

 

California residents can exercise their right directly through the live chat window provided in the App, or by the email address provided in this Policy. We will verify the customer’s identity through the email address, and will respond to the consumers’ requests within 45 days.

 

  1. Do Not Track

We do not track our customers over time and across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals.

 

UK

You may have the following rights in relation to your personal data under the UK GDPR:

·        Right to obtain information on how we use your personal data, including the purposes for which we use it, with whom we share it, how long we retain it, and so forth;

·        Right to access to the personal data we hold about you, including receive a copy of your personal data;

·        Right to have us correct any inaccuracies in the personal data we hold about you (for example, because it is incomplete or out of date);

·        Right to have us delete (erase) your personal data;

·        Right to have us transmit the personal data you have provided to us about yourself to a third party;
